Welcome to BURN - Ventura Lagree (“BURN,” “we,” “our,” or “us”). These Terms of Service ("Terms") govern your use of our website (burnventuralagree.com) and participation in our fitness classes, memberships, and related services (collectively, the "Services").

By accessing our Website or Services, you agree to these Terms and acknowledge that our data collection and privacy practices are governed by our Privacy Policy. Additionally, your participation in BURN classes is subject to the BURN - Ventura Lagree Waiver, which must be reviewed and signed prior to your first session.

1. Membership and Class Policies

A. Membership Terms

  • All autopay memberships require a minimum 3-month commitment to receive any introductory discounts.

  • Early cancellation of an autopay membership within the commitment period incurs a $100 termination fee.

  • Monthly memberships renew automatically unless canceled in accordance with our cancellation policy (below).

B. Cancellation and Refunds

  • Membership cancellations must be requested via email at [Insert Email] at least 7 days before your next billing date to avoid further charges.

  • No refunds are issued for payments already processed.

  • Memberships may be frozen once per year for 30-90 days with at least 14 days’ written notice. Additional freezes will incur a $25 administrative fee, except for documented medical reasons.

C. Class Packages and Drop-Ins

  • Class packages and drop-in purchases are non-refundable, non-transferable, and not eligible for price adjustments.

  • Existing members cannot redeem new client promotions.

2. Booking, Attendance, and Late Policies

A. Class Reservations

  • All classes must be reserved in advance through our website or booking platform.

  • Clients more than 5 minutes late will not be permitted entry, and their spot may be given to a waitlisted client.

  • First-time clients should arrive 10 minutes early for a mandatory safety overview.

B. Cancellation and No-Show Fees

  • Cancellations must be made at least 12 hours in advance. Late cancellations made with less than 4 hours’ notice will incur a $20 fee.

  • No-shows result in a loss of the class credit (for class pack clients) or a $15 fee (for unlimited members).

  • Fees will be automatically charged to the payment method on file.

C. Waitlist Policy

  • If you join the waitlist and a spot becomes available, you will be automatically added to the class up to 1 hour before the scheduled start time. If you cannot attend, please remove yourself from the waitlist in advance.

D. Private Sessions

  • Private sessions require at least 24 hours' notice for cancellation.

  • Late cancellations incur a $50 fee, and no-shows will be charged the full session amount.

3. Studio Policies

A. Age Requirements

  • Minimum age for participation is 13 years.

  • Clients aged 13 to 15 must be accompanied by a parent/guardian.

  • A signed parent/guardian consent form is required for clients under 18.

B. Grip Socks Requirement

  • Grip socks are mandatory for safety and hygiene. Clients without grip socks must purchase a pair before class.

C. Personal Belongings

  • BURN is not responsible for lost, stolen, or damaged personal items. Clients assume full responsibility for their belongings.

D. Payment Methods

  • We accept Visa, Mastercard, American Express, and Discover.

  • Personal checks are not accepted.

E. Schedule Changes

  • Instructors and class schedules are subject to change without prior notice.

4. Retail Purchases and Returns

  • All retail purchases (e.g., apparel, accessories) are final sale.

  • Exchanges for store credit may be allowed within 14 days of purchase, provided items are unworn, unwashed, and in original packaging.

5. Website and Service Use

A. User Conduct

By using our Website or booking Services, you agree not to:

  • Use automated systems to scrape or access our content.

  • Copy, modify, or distribute our proprietary information without permission.

  • Engage in fraudulent activities, hacking, or malicious interference with our systems.

B. Intellectual Property

  • All website content, branding, and class programming are the intellectual property of BURN.

  • You may not reproduce, republish, or distribute our materials without prior written consent.

6. Medical Emergencies and Safety Compliance

  • In the event of an emergency, BURN may seek medical assistance on your behalf. You agree to be responsible for any related costs.

  • Clients must disclose any physical concerns or limitations before participating in sessions. See BURN - Ventura Lagree’s Waiver for additional details on health disclosures and personal responsibility.

7. Dispute Resolution

  • Any disputes arising under these Terms shall be resolved through binding arbitration in Ventura County, California.

  • You waive the right to a jury trial or class-action lawsuit related to disputes with BURN.

8. Modifications to These Terms

We may update these Terms periodically. Changes will be posted on our Website with an updated Effective Date. Your continued use of our Services following updates to these Terms is subject to our Privacy Policy.
